DRIVER TERMS & CONDITIONS

1. AGREEMENT

This Driver Terms & Conditions (“Agreement”) is entered into and shall be deemed effective as of the date of acceptance by the Driver through the DRIVERS 24/7 platform operated by RAMS Travel AppSuite LLP. This Agreement is made between RAMS Travel AppSuite LLP, having its registered office at No. 24/2, Samarpan Nilaya, 3rd Main Road, Byatarayanapura New Extension, Bengaluru – 560026 (hereinafter referred to as the “Company” or “Platform”), which expression shall, unless repugnant to the context, include its partners, successors, assigns, and permitted representatives, and the individual driver who registers and provides services through the Platform (hereinafter referred to as the “Driver”), which expression shall include legal heirs, successors, and permitted assigns.


By clicking “Accept & Continue ”, digitally signing, or continuing to use the Platform, the Driver confirms that this Agreement has been read, understood, and accepted.


2. PURPOSE OF THE AGREEMENT

The Company operates a technology-enabled platform facilitating professional driver services to customers. The Platform enables registered Drivers to connect with Customers seeking driving services on a request basis. The Driver voluntarily agrees to offer such services independently through the Platform.


3. DRIVER STATUS

The Driver acknowledges and agrees that they operate as an independent contractor and not as an employee, agent, partner, or representative of the Company. Nothing in this Agreement shall be construed to create an employer-employee relationship, joint venture, partnership, or agency relationship between the parties.


4. DRIVER ELIGIBILITY & DOCUMENTATION

The Driver represents and warrants that they possess a valid driving licence for the applicable vehicle category, that all submitted documents including Aadhaar, PAN, RC, insurance, PUC, and permits are genuine, accurate, valid, and up to date, that no criminal record or pending legal proceedings exist that affect eligibility, and that the Driver is medically and physically fit to operate a vehicle. The Driver acknowledges that failure to maintain valid documentation may result in suspension or permanent deactivation from the Platform.


5. VEHICLE STANDARDS & MAINTENANCE

The Driver agrees to ensure that any vehicle used on the Platform is legally registered, adequately insured, roadworthy, clean, safe for operation, compliant with Company-defined service and safety standards, and not operated with expired, invalid, or falsified documentation.


6. APP USAGE & TECHNOLOGY COMPLIANCE

The Driver agrees to use only the official Driver Application, maintain active GPS, mobile data, and required permissions, refrain from manipulating routes, fares, surge pricing, or trip data, avoid sharing login credentials, and not use rooted or jail-broken devices. Any misuse, tampering, or unauthorized use of the Platform may result in immediate legal auction including damages, blocking and Blacklisting of the party of the third part.


7. DRIVER CONDUCT & SERVICE STANDARDS

The Driver agrees to conduct themselves in a professional, respectful, and lawful manner at all times, avoid harassment, abuse, discrimination, or disputes with customers, follow navigation instructions unless otherwise requested by the customer, maintain vehicle cleanliness and service quality, and refrain from demanding additional payments or negotiating fares outside the Platform in the event of failure to adhere to the policy on any complaint received in this regard would result in forfeiture of all or any payments pending to the driver.


8. SAFETY & ZERO-TOLERANCE POLICY

The Driver acknowledges that consumption or carrying of alcohol or drugs, rash or negligent driving, harassment, misconduct, impersonation, or account sharing is strictly prohibited and may result in immediate suspension or permanent deactivation without prior notice and immediate legal auction including damages, blocking and Blacklisting of the party of the third part.


9. TRIP HANDLING RULES

The Driver agrees to accept assigned trips promptly, avoid unnecessary or invalid cancellations, commence and complete trips strictly through the Application, and refrain from requesting customers to cancel bookings for personal or financial reasons.


10. REMUNERATION

The Driver understands that earnings are calculated on a per-trip basis and are subject to applicable platform fees, commissions, penalties, and taxes. Incentives are performance-based, discretionary, and subject to modification or withdrawal. Payouts shall be processed as per the party of the third part settlement cycle as per Annexure-A and any disputes related to earnings must be raised within forty-eight (48) hours of payout.


11. DRIVER REFUND & CANCELLATION POLICY

Driver-initiated cancellations shall be permitted without penalty only for valid reasons including customer unreachability, illegal or unsafe requests, prohibited items, vehicle breakdowns, emergencies, or incorrect pickup locations, while cancellations due to short trips, destination preference, surge chasing, requesting customers to cancel, or cancelling after arrival without cause may attract penalties. Customer cancellations prior to driver arrival shall not attract penalties, while cancellations after arrival may result in applicable fees. In the event of a customer no-show, the Driver may be eligible for a no-show fee, whereas driver no-shows may result in penalties or suspension. Refunds or adjustments may be requested only for incorrect fares, missing eligible cancellation fees, technical errors, or wrongful deductions, and shall not be issued for valid penalties, misconduct, fraud, or delayed disputes.


12. ACCIDENT ASSISTANCE & LIABILITY

This Policy applies to accidents occurring during Platform trips, while en route to pick-up or drop-off, or involving customers, third parties, or property. In the event of an accident, the Driver must stop safely, ensure the safety of all persons, contact emergency services where required, promptly inform the Company or Franchise, and cooperate fully with police, insurers, and authorities. The Driver shall provide reasonable assistance to customers, including facilitating emergency contact and insurance or FIR processes, without such assistance constituting admission of fault. To the maximum extent permitted by law, the Driver shall not be liable for injuries, death, property damage, or insurance outcomes unless determined by a competent authority, and all compensation shall be governed solely by applicable insurance policies.


13. FRAUD, MISREPRESENTATION & MISUSE

The Driver agrees not to engage in fraudulent activities including fake trips, GPS tampering, collusion, incentive abuse, or false accident claims, and acknowledges that such actions may result in immediate termination and legal proceedings.


14. SUSPENSION & TERMINATION

The Company reserves the right to suspend or terminate Driver access for policy violations, safety breaches, fraud, misconduct, or repeated poor performance, with severe violations resulting in immediate permanent deactivation apart from forfeiture of any payable dues from the FIRST PARTY.


15. LOCATION PERMISSIONS, BACKGROUND TRACKING AND DATA & PRIVACY

The Driver Application may require limited camera access strictly for operational purposes such as scanning QR codes, document uploads, or identity and vehicle verification, with such access being enabled only while the application is active and solely for the stated purpose. The Company does not engage in continuous or background camera monitoring, and any images or videos captured are not stored or shared except where required for verification, safety, dispute resolution, or legal compliance. No personal data, images, or videos are shared with third parties except as required by law, and continued use of the Application constitutes explicit consent to such limited access.


The Driver acknowledges that personal data may be collected and processed for operational, legal, safety and compliance purposes in accordance with applicable laws and agrees not to misuse or unlawfully disclose customer data.


16. EARNINGS DISCLAIMER

The Company does not guarantee minimum earnings, fixed income, or trip volume. Earnings depend on demand, compliance, performance, and platform policies.


17. DRIVER INDEMNIFICATION

The Driver agrees to indemnify and hold harmless the Company and its Franchise partners against losses, damages, penalties, or claims arising from negligent driving, document falsification, misconduct, illegal activities, or violation of platform policies.


18. NOTICES & COMMUNICATION

The Company may communicate through in-app notifications, SMS, email, or registered contact details, and such notices shall be deemed delivered once electronically transmitted.


19. GOVERNING LAW & JURISDICTION

This Agreement shall be governed by and construed in accordance with the laws of India, and all disputes shall be subject to arbitration or courts of competent jurisdiction at Bengaluru.
